Deadline Feb. 6 to file for potential offices created by Zionsville, Perry Township reorganization

Residents wishing to run in the May 5 primary election – including for offices created by the reorganization between the Town of Zionsville and Perry Township – must submit their candidacy no later than Feb. 6. This filing deadline applies to the newly created office of the mayor of Zionsville.

The reorganization is the subject of two different lawsuits brought by the Town of Whitestown. One suit is pending before the Indiana Court of Appeals and seeks to overturn an order determining that the reorganization did not satisfy certain requirements of Indiana statutes allowing reorganizations. At Zionsville’s request, the Court of Appeals has agreed to give expedited treatment to the appeal in light of the important issues it raises. A ruling is expected soon.

If the court rules in Zionsville’s favor, the reorganization with Perry Township would proceed immediately and the May 6 primary election would include the office of mayor. While the reorganization remains subject to this litigation, residents may seek to run in the primary election by filing the appropriate forms with the Boone County Clerk.

The other lawsuit brought by Whitestown seeks to invalidate the results of the vote on the reorganization during the November 2014 general election. A majority of the voters in that election approved the reorganization. In this lawsuit, Whitestown sued the Boone County Clerk and Election Board and has asked the court to void the voters’ approval of the reorganization. Zionsville has intervened in that lawsuit to ensure that the interests of both Zionsville and those who voted in the election are heard in the case.
